ORDER
The petitioner who apprehends arrest for the alleged offences under Sections 126(2), 296(b), 115 (2), 118(1) and 351(3) and 109 of BNS, 2023 in Crime No.131 of 2025 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that due to the wordy quarrel between the defacto complainant and the accused in the Temple Festival, the accused were waylaid the defacto complainant with inebriated conditions and they assaulted with knife and beer bottles. Due to the same, the defacto complainant sustained injuries and admitted in the Hospital. 3.The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case. The petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the defacto complainant was attacked by the petitioner and he sustained injuries and admitted in the hospital. Hence, he 2\6
vehemently opposed to grant bail to the petitioners. 5.Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6.Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.II, Thiruvallur, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a)the petitioner is directed to deposit a sum of Rs.
10,000/- (Rupees ten thousand only) to the credit of Crime No. 131 of 2025 before the concerned Magistrate from the date on which this order is made ready and the defacto complainant is permitted to withdraw the said amount.

(d)the petitioner shall not tamper with evidence or witness either during investigation or trial;
(e)the petitioner shall not abscond either during investigation or trial; (f)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (g)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
