ORDER
The criminal original petition has been filed seeking to cancel the anticipatory bail granted by the learned Principal Sessions Judge, Puducherry in Crl.M.P.No.3507 of 2024 dated 20.08.2024.
2. It is the case of the petitioner that the accused, after obtaining Anticipatory bail, did not cooperate for the investigation. 3.The learned Additional Public Prosecutor (Puducherry) appearing for the petitioner would submit that this petition has been filed seeking to cancel the anticipatory bail, since the respondent/accused did not cooperate for the investigation.
4. Per contra, the learned counsel appearing for the respondent/ accused would submit that the respondent/accused has been regularly appearing before the petitioner/Inspector of Police for investigation as and when called for and further, the respondent has also handed over the three documents i.e. (i).Original registered sale deed under document No.6293/2022, dated 04.03.2022. (ii).Certified copy of registered will
under document No.12/1980, dated 12.03.1980 and (iii).Certified copy of judgment and decree in O.S.No.03/2017, dated 14.03.2017 on the file of Hon'ble Additional District Judge, for further investigation and the respondent has also cooperated with the investigation and in such circumstances, the bail granted to the respondent/accused need not be cancelled.
5.Heard the learned Public Prosecutor (Puducherry) appearing for the petitioner as well as the learned counsel appearing for the respondent and perused the materials available on record. 6.Taking into consideration of the fact that the respondent/accused has cooperated for investigation and that, she also handed over the documents mentioned above, this court is not inclined to entertain this petition. Accordingly, the criminal original petition stands dismissed.
