O R D E R

The petitioner has filed this Writ Petition for the following relief:-

To issue mandamus upon the second respondent to reinstate the petitioner in service with backwages with effect from 10.08.2015, as per 12 (3) settlement entered into between the petitioner and the second respondent, dated 10.08.2015.

Heard the learned counsel appearing for the parties. 3.

The President of the respondent/Society has not filed counter affidavit, but the Vice President of the Society, who was impleaded as third respondent, raised an objection, stating that the President of the Society was not authorized to enter into any settlement. However, it has to be noted that settlement was entered into between the petitioner and the second respondent, in terms of 12 (3) of Industrial Disputes Act, 1947, before the Labour Officer. Therefore, as long as settlement has not been challenged and canceled in the manner known to law, the petitioner could seek for enforcement of the settlement. Accordingly, the Writ Petition is disposed of, granting liberty to the petitioner to enforce the terms of the settlement, by filing proper application before the Labour Court, Salem, which shall be considered on merits and in accordance with law. No costs. Consequently, connected Miscellaneous Petition is closed.
