O R D E R
The prayer in the writ petition is to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner application dated 10.08.2019 under Section 17 of Indian Telegraph Act, within time bound manner.
2. There is no representation for the petitioner for the second time.
3. The petitioner wants to relocate the transformer alignment which has been erected by the respondents 2 and 3. He has given an application under Section 17 of the Indian Telegraphic Act, 1885 to the District Collector on 10.08.2019. Hence, he seeks for Mandamus to direct the first respondent to consider his application dated 10.08.2019.
4. The learned Additional Government Pleader appearing for the first respondent would submit that the petitioner herein infact has given the application under Section 17 of the Indian Telegraphic Act, 1885 on 10.08.2019 and the same was received by the District Collector. After considering the objections, the District Collector has rejected the request and the reply to the writ petitioner was sent vide Ref.No.26667/2016/K4 dated 24.09.2019 in which the details of final route approval with GPS Co-ordination numbers etc., has been furnished to the writ petitioner.
5. Therefore, having considered the request of the petitioner under Section 17 of the Indian Telegraphic Act, 1885 and duly intimated to him, the learned Additional Government Pleader appearing for the 1st respondent would submit that nothing survives in this writ petition.
6. Recording the same, the writ petition is dismissed as infrcutuous. No costs. Consequently, connected Miscellaneous Petition is closed.
