Following an order of allowing the application to implead the LRs of the 1st defendant, no consequent amendment has been carried out within the time stipulated.

2.Today, the application in A.No.4910 of 2021 is filed to condone the delay of 238 days in carrying out the amendment to the plaint.

3.Since the suit is of the year 2006, and which needless to mention is in its 16th year of institution, it is important that the plaintiff realises her responsibility in prosecuting the litigation. The delay is absolutely avoidable, however, in the interest of substantial justice, this application is allowed on payment of cost of Rs.1,000/- (Rupees One Thousand Only) payable to the Chief Justice Relief Fund.
