C.M.A.No.1414 of 2017 and C.M.P.No.7545 of 2017 V. BHAVANI SUBBAROYAN, J., Earlier this Court in C.M.A.No.1414 of 2017 has passed an order dated 28.11.2018, directing the III Additional District Judge, Puducherry to dispose of O.S.No.26 of 2016 by taking up the matter on a day to day basis without giving any adjournment to either of the parties and dispose of the same in accordance with law, within a period of four months from the date of receipt of a copy of that order. 2.The III Additional District & Sessions Judge, Puducherry has sent a letter to the Registrar General, High Court of Madras on 05.09.2019 stating that notice was issued to both the parties and their counsels and the plaintiff has filed a petition under Order VIII rule 9 r/w Sec.
151 of CPC seeking permission to file reply statement to the written statement filed by the defendants 1 and 2 and the same was disposed on 01.08.2019. On 09.08.2019, the second defendant filed an application to condone the delay in filing the petition mentioned documents and the said application was filed and the documents were received on file. Cross-examination was conducted and P.W.1 was examined on 20.08.2019 and on 22.08.
matter was posted again for examination of summoned plaintiff's side witnesses. Meanwhile, the time granted by this Court has expired. Therefore, an extension of four months time is sought for disposal of O.S.No.26 of 2016.
3.The Hon'ble Judge has passed an Order stating that the matter has to be taken on a day to day basis without giving any adjournment to either of the parties and to dispose of the same in accordance with law, but, the same was not adhered to by concerned Court or by the parties. However, in order to give one more opportunity, the III Additional District & Sessions Judge, Puducherry is directed to take up the matter on a day to day basis and to dispose of the same within a period of two months from the date of receipt of a copy of this Order.
