This Miscellaneous Petition has been filed to condone the delay of 393 days in filing the Writ Appeal.

2. A better affidavit has been filed by the Appellants/Department, showing reasons for the inordinate delay in filing the Writ Appeal. Though we are satisfied with the reasons to condone the delay, condoning the delay simpliciter will cause much hardship to the respondent herein and therefore, we are of the view that the prejudice caused to the respondent can be compensated by way of costs and the same has been reiterated by the learned counsel for the respondent.

3. Hence, the appellants / Department are directed to pay a sum of Rs.3,000/- as costs to the learned counsel for the respondent within a period of two weeks from today and a memo to that effect needs to be filed before the Registry. The Department is at liberty to recover the said sum from the Officer concerned, who is responsible for the delay.

List this matter after two weeks for reporting compliance.
