ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Section 342, 370(2) of IPC r/w Sections 3(1), 3(2)(b), 4(1), 5 (1)(a) of Immoral Traffic (Prevention Act) 1956 in Cr.No.1252 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that based on a secret information, the defacto complainant along with his police officials went to a place where suspiciously, a person came out of a house. When the police enquired him, he reveals that the petitioner is owner of the said house and were using the house for prostitution works. Further, the police rescued a women aged 28 years who was forcefully subjected into the prostitution and arrested the accused/A2. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and based on the confession statement of A2, he has been falsely implicated in this case. He further submitted that the coaccused person has already released on bail. Hence prays for grant of anticipatory bail.

4.The learned Additional Public Prosecutor submitted that the petitioner is the owner of the said property where he is conducting prostitution and forcibly involving minor girls into prostitution. He https://hcservices.ecourts.gov.in/hcservices/

further submitted that there are three previous cases pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the allegation levelled against the petitioner that he is forcibly involving minor girls into the prostitution which needs detailed investigation, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
