PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate Writ or directions or orders in the name of the Writ of Mandamus, to direct the respondent to issue a non-traceable certificate for the petitioner's lost the original parent sale deed document No.4128 of 2001 dated 22.11.2001 registered before the Sub Registrar office, Redhills based on the petitioner's representation dated 27.07.2023.

This Writ petition has been filed for a direction to the respondent to issue a non-traceable certificate for the original parent sale deed document No.4128 of 2001 dated 22.11.2001 registered before the Sub Registrar office, Redhills, based on the petitioner's representation dated 27.07.2023.

2. Heard Mr.B.Govindaprabu, learned counsel appearing for the petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondent.

The petitioner has given a complaint before the respondent on 27.07.2023 seeking for non-traceable certificate on the ground that the original parent document was lost and hence, unless non-traceable certificate is obtained from the police, the petitioner will not be able to proceed further to deal with the property. Since no action was taken, the present petition has been filed.

4. Taking into consideration the facts and circumstances of the case, there shall be a direction to the petitioner to appear before the respondent and co-operate for the enquiry by submitting all the necessary documents. The respondent shall conduct enquiry in line with the circular issued by the Director General of Police of Tamil Nadu dated 01.04.2022 and shall take a final decision within a period of six (6) weeks from the date of receipt of copy of this order.
