This Criminal Miscellaneous Petition has been filed to exempt the petitioner from surrendering pursuant to the judgment dated 15.10.2020 passed in C.C.No.271 of 2017 on the file of the Judicial Magistrate, Sulur and confirmed by the judgment dated 30.08.2022 passed in CA.No.204 of 2020 on the file of the V Additional District and Sessions Judge, Coimbatore pending disposal of the above Criminal Revision Case.

2. The learned Counsel for the petitioner would submit that at the time of dismissal of the Criminal Appeal, the appellant/accused was not present before the learned V Additional District and Sessions Judge, Coimbatore. Therefore, the V Additional District and Sessions Judge, Coimbatore had issued NBW to secure the accused. Hence, he seeks exemption from surrendering before the trial Court.

3. In the light of the above, the exemption from appearance before the Court concerned is granted for the petitioner. Accordingly, this Criminal Miscellaneous petition is ordered.
