WP No. 26693 of 2021 Prayer: This writ petition is filed under the Article 226 of the Constitution of India, for the issuance of Writ of Certiorarified Mandamus, calling for records relating to the 2nd respondents order made in Memorandum No. 4187 / APDB1 / 2019 dated 25.11.2021 to quash the same and to consequently direct the respondents to select and appoint the petitioner in any one of the post of Assistant Director of Industries and Commerce (Technical and Assistant Superintendent (Chemical Wing) in the Department of Micro, Small and Medium Industries Service for the year 2019 pursuant to Notification No. 34 / 2019 Advertisement No. 564 dated 09.12.2019 __________Page 2 of 6

Mr.R.Bharanidharan, SC COMMON ORDER Mr. L. Chandrakumar, learned counsel appearing for the petitioners in W.P. Nos. 26693 & 26757 of 2021, submits that pursuant to the orders of this Court, the petitioners (in all the present writ petitions) were permitted to participate in the oral test. He further submits that by an order dated 20.12.2021, this Court permitted the respondents to declare the results of the said oral test, according to which the petitioners did not fall within the zone of consideration. 2.Learned counsel appearing for the respondents submitted that since the petitioners failed to come within the zone of consideration, they were not __________Page 3 of 6

selected for appointment. Consequently, he submitted that the cause of action in the writ petition does not survive.

3.In view of the aforementioned submissions, and since the petitioners, having been permitted to participate in the written and oral tests, failed to secure selection for appointment, this Court is of the view that the cause of action in these writ petitions does not survive for consideration. Accordingly, no further orders are necessary.
