ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 123 of BNS and Section 7, 20(1) of COTPA Act, 2003, and Section 4(1)(c) of TNP Act in Crime No.289 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was in illegal possession of 326 kgs of banned tobacco products and 8 litres 100 ml of Karnataka State Liquor. Hence this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, sought for anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner. He submitted that there are totally 3 accused in this case and the petitioner is A2. On the confession of A1, the petitioner is arrayed as an accused. 5.Considering the facts and circumstances of the case that the petitioner is the supplier of the Tobacco products and he is in possession of 3\6

326 kgs of banned tobacco products and 8 litres 100 ml of Karnataka State Liquor and the case is under the investigation. The petitioner's custody interrogation is necessary. At this juncture, this is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is dismissed. 09-09-2025 mps 4\6
