2. Despite the receipt of notice and the details of the 2nd respondent having been printed in the cause list, on behalf of the 2nd respondent Insurance Company, neither any representative appears nor entered appearance through their counsel.
3. The first petitioner would aver that due to financial constraints in obtaining the copy application, delay of 445 days occurred in preferring the Civil Miscellaneous Appeal.
4. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 445 days shall stand waived.
