O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b) (ii)(B), 25 of NDPS Act and Section 4(1)(C) and 4(1-A) (ii) of TNP Act, in Crime No. 197 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/6
2.The case of the prosecution is that on 25.05.2025, the petitioner along with others were illegally sold the banned tobacco products and liquor bottles. The respondent police have seized 90 ML of original choice delux whisky (Karnataka Liquor) and one unsealed and opened 180 ML of poisonous brandy bottle using VOLKWAGAN car bearing Registration No.KA-03-MN-8514 and one unsealed and opened 180 ML of poisonous brandy bottle and 1.329 mg of yellow coloured tablets using GLAZA car bearing Registration No.KA-03-NU-746. Hence the respondent police registered a case against the petitioner and others.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case based on the confession statement of the co-accused and no property has been recovered from the petitioner. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that huge quantity of banned tobacco products sold by the petitioner herein and investigation has been pending against him. Therefore, he opposed for grant of anticipatory bail to the petitioner.

Taking into the aforesaid submissions made by the learned counsels on either side; that the gravity of the offence committed by the petitioner herein; that huge quantity of banned tobacco products as well as liquor bottles were sold by the petitioner herein in public place; the properties have not yet recovered from the petitioner, and hence, this Court is not inclined to allow this Criminal Original Petition.
6. Accordingly, this Criminal Original Petition is dismissed. 24.09.2025 MSM 3/6
