O R D E R
The civil revision petition is filed to strike out the complaint/proceedings in D.V.C.No.3 of 2023 on the file of the Judicial Magistrate Court, Tiruttani and quash the same.
2. When the matter was taken up for hearing, learned counsel for the parties submitted that, since the parties had arrived at a compromise before the Mediation Centre and agreed to file a petition for mutual consent divorce before the concerned Family Court, on 19.12.2023, this Court had directed the concerned Family Court to dispose of any such application filed by the parties, within a period of four weeks.
3. Learned counsel for the parties further submitted that the parties have filed a petition in HMOP No.4 of 2024 on the file of the learned Subordinate Court, Tiruttani seeking mutual consent divorce. Therefore, a direction may be given to the learned Subordinate Court, Tiruttani to dispose of the same.
4. Recording the submissions made by the learned counsel for the parties and since the matter has been settled before the Mediation, the learned Subordinate Court, Tiruttani, is hereby directed to dispose HMOP No.4 of 2024, within a period of four weeks from the date of receipt of a
copy of this order.
5. In view of the above, DVC proceedings in D.V.C.No.3 of 2023 is hereby quashed and consequently, the civil revision petition is allowed. There will be no order as to costs. Consequently, CMP No.20655 of 2023 is closed.
