The Petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b) and 506(ii) of IPC., r/w 3(i) PPD Act, in Crime No.317 of 2016, seeks anticipatory bail.

2. The learned counsel appearing for the Petitioner would submit that at the time of filing charge sheet, the Petitioner was abroad and he was not able to appear before the learned Judicial Magistrate - I, Vridhachalam, in respect of the case in PRC.No.62 of 2017 and hence, non-bailable warrant had been issued against the Petitioner. He would further submit that the said absence is neither willful nor wanton and he undertakes that the Petitioner will appear before the Court below regularly on all future hearing dates without fail.

3. The learned Government Advocate (Crl.Side) would submit that the non-bailable warrant had been issued against the Petitioner and

the same is pending. He further submit that the Petitioner herein is shown as absconding accused before the Judicial Magistrate-I, Vridhachalam.

4. Considering the undertaking given by the learned counsel for the Petitioner, the Petitioner is directed to appear before the learned Judicial Magistrate-I, Vridhachalam, within a period of two weeks from today and to file a petition to recall NBW already issued against him. On filing of such petition, the concerned learned Judicial Magistrate is directed to consider the same on merits and pass orders on the same day.
