Respondent Prayer: Writ Petition filed under Article 226 of the constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the respondent in the order dated 04.10.2016, quash the same and consequently direct the respondent to register the gift deed presented by the petitioner for registration dated 27.09.2016 and bearing pending document No.117/2016 without insisting on payment of additional stamp duty/registration fees.

O R D E R

The learned counsel appearing for the petitioner seeks permission of this Court to withdraw the petition and he has also made an endorsement to that effect in the Writ Petition. He further submitted that he had paid the stamp duty only under protest and to get the document released and in the meanwhile, the respondent has also issued notice to the respondent in the appeal.

2. In view of the endorsement of the learned counsel for the petitioner, the present Writ Petition is dismissed as withdrawn. Consequently, the connected miscellaneous petitions are closed. However, the petitioner is at liberty to challenge the order of the respondent in the appeal.
