O R D E R

This petition has been filed to direct the respondent to transfer the investigation of Crime No. 502 of 2022 from the file of the second respondent to the CBCID or any other independent investigating agency under the supervision of the first respondent and to complete the investigation and file a final report within a stipulated period.

2. On the demise of the petitioner's son due to an accident, F.I.R has been registered in Crime No.502 of 2022 under Section 174 of Cr.P.C., as if, the petitioner himself fell down. Subsequently, on investigation found that it was hit and run case. Accordingly, the 2nd respondent altered the charges under Sections 279 and 304 of I.P.C and now the investigation is pending to trace out the offending vehicle. Therefore, change of investigation would not serve any purpose since the 2nd respondent has already altered the charges and taking steps to find out the offending vehicle.

3. In view of the above, this Criminal Original Petition is dismissed. The 2nd respondent is directed to complete the investigation and file final report, within a period of 16 weeks, from the date of receipt of copy of this order.
