PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 & 2 to consider his representation of the petitioner dated 02.01.2017 within a reasonable time and also direct the respondent to restore the petitioner land to the petitioner and pay damage to the tune of Rs.10,00,000/- to the petitioner. ORDER

The prayer of the petitioner is for a mandamus directing R1 and R2 to consider his representation dated 02.01.2017 seeking restoration of certain lands that the petitioner claims belong to him. He also seeks ddamages to the tune of Rs.10.00 lakhs.

2. Mr.B.Vijay, learned Additional Government Pleader appearing for the respondents would have no objection to this Court fixing a time frame for disposal of the representation. He would submit that the appropriate authority to dispose the representation of the petitioner is the Revenue Divisional Officer, Virudhachalam and not Thitagudi.

3. Hence, the description of R3 is accordingly amended to read 'Revenue Divisional Officer, Virudhachalam'.

4. Since no representation has been sent to R3, the petitioner is permitted to send a representation to R3 and such representation, if received, within a period of eight (8) weeks from today, shall be disposed by R3 after hearing the petitioner, within a period of eight (8) weeks from date of the same.

5. This Writ Petition is disposed as above. No costs. Connected Miscellaneous Petition is closed.
