Original Petition praying that this Hon'ble Court be pleased that Succession certificate may be granted in favour of the 1st petitioner with the power to collect the securities and to receive the interest, dividends and negotiate and transfer the securities specified in the schedule in the petition. This Original Petition coming on this day before this court for hearing the court made the following order:
This matter has been listed today under the caption "Being Mentioned".
2. This Court by order dated 09.12.2021 granted Succession Certificate as prayed for by the learned counsel for the petitioners in OP No.892 of 2019.
3. It is now submitted by the learned counsel for the petitioners that Registry is not issuing Succession Certificate in favour of the first petitioner though the prayer sought for in OP NO.892 of 2019 was only for a direction to issue Succession Certificate in favour of the first petitioner.
4. This Court has perused and examined the prayer sought for in OP No.892 of 2019.
5. As rightly contended by the learned counsel for the petitioners, the prayer sought for in OP No.892 of 2019 was only to issue Succession Certificate in favour of the first petitioner alone.
6. Therefore, it is clarified by this Court that the Succession Certificate will have to be issued in favour of the first petitioner alone in accordance with the order passed by this Court on 09.12.2021 in OP No.892 of 2019.
7. Registry is directed to issue Succession Certificate in favour of the first petitioner within one week from today.
