O R D E R
This writ petition has been filed by the petitioner to direct the respondent corporation to grant permission to the petitioner herein to remove the ICF furnishing Zero value waste/garbage from ICF to Kodungaiyur dumping site without imposing any stringent conditions and terms immediately and pass orders on the representation dated 23.03.2017 immediately considering the above acts and circumstances of the case.
2. Learned counsel for the petitioner submitted that the petitioner by representation dated 24.06.2016 requested the respondent Corporation to permit the dumping of 500 metric tonnes of ICF furnishing division waste at Page No.2 of 6
the Kodungaiyur dumping yard, enclosing the ICF acceptance letter. The Corporation, by proceedings, dated 30.06.2016 (RDC(N) SWMC No.E6/4492/2016), granted permission on payment of Rs.2,80,500/- at Rs. 561 per metric tonne, valid till 31.12.2016, with certain conditions. The petitioner complied by submitting the requisite Demand Draft, and permission was granted after site inspection and verification by the Corporation's Chief Engineer. Subsequently, by letter dated 22.11.2016, the petitioner sought permission to dump 1000 metric tonnes of ICF shell division waste, followed by reminders on 23.03.2017. But received no response. Due to continued delays and hardships, waste accumulates at ICF, causing objections from ICF authorities and nearby residents due to health hazards and pollution, thereby threatening the execution of the contract. Hence, the petitioner has come forward with the present writ petition.
3. Learned Standing counsel appearing for the respondents would submit that the relief sought for in this writ petition pertains to the year 2017, and as we are in the year 2025, no further adjudication is required. Page No.3 of 6
