Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for records from second respondent vide Na.Ka.no.5218/2023/A1 dated 01.11.2023 rejection of petitioner's application for re-issuing patta in respect of property which is situated at Old S.F.No.132/7A, (Part New Survey No.132/48, Polt No.298-B, Kubera Nagar, 10th street Kancheepuram District with extent of 2450sq.ft. quash the same consequently direct the first respondent to grant the patta in the name of the petitioner and A.Geetha whose are absolute owners of the 1/4
property.

Though the writ petition is filed challenging the order passed by the second respondent rejecting the petitioner's application seeking issuance of patta in respect of the property situated in Old S.F.No.132/7A, (Part New Survey No.132/48, Polt No.298-B, Kubera Nagar, 10th street Kancheepuram District and seeking a direction to the first respondent to grant patta in the name of the petitioner and A.Geetha, at the time of argument, the learned counsel for the petitioner submitted that challenging the impugned order, the petitioner filed an appeal before the first respondent and she would be satisfied, if a direction is issued to the first respondent to dispose of the appeal filed by her.

3. Even as per the averments made in the affidavit filed in support of the writ petition, the petitioner filed an appeal before the first respondent on 29.11.2023 challenging the impugned order dated 01.11.2023 and the same is pending without any progress.
4. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents would submit that the appeal of the petitioner would be considered on its own merits and appropriate orders will be passed.

In view of the above submission made by the learned Additional Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to consider the appeal filed by the petitioner dated 29.11.2023 and pass final orders, after issuing notice to all the interested parties, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. No costs. 03.10.2024 Index : Yes/No 3/4
