Heard the submissions of the learned counsel for the petitioner and Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor appearing on behalf of the respondent.
The petitioner is in jail. The petition is ordered and the delay of 1024 days in filing the present criminal appeal filed against the judgment passed in S.C.No.45 of 2015, dated 16.09.2016, on the file of the learned Principal Sessions Judge, Dharmapuri is hereby condoned.
The Registry is directed to number the above Criminal Appeal if it is otherwise in order and list the same for hearing.
