The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 120B, 409, 420 of I.P.C. and under Section 5 of TN Protection of Interest of Depositors (In Financial Establishment) Act, 1997, in Cr.No.05 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with the other accused are alleged to have introduced various attractive Schemes under the name of Daily Max Solution and collected amount to the tune of Rs.20 Crores from various depositors and thereafter they neither returned the benefits nor repaid the amount deposited by the depositors. Hence the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and that he has been falsely implicated in the case. The learned counsel further submitted that the petitioner is victim to the crime committed by the other accused, however, he is arrayed as A6 1/3

in the case. The earlier petitions seeking anticipatory bail filed by the petitioner were dismissed by this Court, however, now substantial investigation is over and hence, this Court may consider for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Criminal Side) submitted that investigation reveals that the accused in the case have collected more than Rs.20 Crores from nearly 1,500 depositors and have cheated them and further submitted that earlier, the petitioner approached this Court by filing Crl.O.P.Nos.17250 of 2020 and 9527 of 2023 and this Court has dismissed the said petitions. 5.Considering the heinous offence committed by the petitioner and since huge amount is involved in the case and since there is no change in circumstances subsequent to the order passed in Crl.O.P.Nos.17250 of 2020 and 9527 of 2023, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. 27.09.2023 pri 2/3
