Respondents Prayer: Criminal Original Petition is filed under Section 482 of Cr.P.C., to transfer the investigation from the file of 2nd respondent police to file of the 1st respondent police viz., The Deputy Superintendent of Police, District Crime Branch, Thiruvallur, Thiruvallur District, pending investigation on a complaint given by the petitioner dated 29.02.2016 for impartial investigation.

O R D E R

The petitioner has come forward with this petition to transfer the investigation from the file of 2nd respondent police to file of the 1st respondent police viz., the Deputy Superintendent of Police, District Crime Branch, Thiruvallur, Thiruvallur District, pending investigation on a complaint given by the petitioner dated 29.02.2016 for further investigation.

2. The learned counsel for the petitioner submitted that the petitioner is a widow, she has given a complaint against one Ekambaram, who worked as Assistant in the rice business of her husband, stating that he has taken away a sum of Rs.60,00,000/- https://hcservices.ecourts.gov.in/hcservices/

from their customers, but he has not repaid the amount. But the respondents have not shown any interest to investigate the matter. He would further submit that the the petitioner has filed a separate petition seeking for a direction to register a case. Hence, he prays for transfer of investigation from the respondent police to any other agency.

3. Heard the learned Additional Public Prosecutor appearing for the respondents.

4. Considering the above submission, I am of the view that since the case is yet to be registered, there is no point for transfer of investigation. Hence the Criminal Original Petition is dismissed.
