The first appellant died. In respect thereof, three separate miscellaneous petitions, in C.M.P.Nos.18876, 18878 and 18880 of 2022, have been filed for condonation of delay, setting aside the abatement and impleading the legal heirs, and the same have been ordered by a separate order.
2. While so, this above C.M.P.No.20512 of 2017 is with the prayer to condone the delay of 338 days in representing the suit in A.S.SR.No.63056 of 2017. The Appeal Suit was already numbered in the year 2014, and therefore, there is no question of filing any condone delay petition in representing the Appeal Suit in the year 2017. Further, the S.R. number is also not pertaining to the present Appeal Suit. Therefore, the above C.M.P.No.20512 of 2017 is erroneously filed and the condonation of delay thereof is absolutely absurd. Hence, the C.M.P.No.20512 of 2017 is dismissed.
