ORDER

The petitioner has filed the present Writ Petition for issuance of a Writ of Mandamus to direct the second respondent to register FIR on the basis of the petitioner's complaint dated 18.07.2025, to take immediate steps to investigate the same and proceed in accordance with law.

2. The petitioner-Company is engaged in infrastructure and logistics operations and is a registered Transporter with Ramco Cements and other cement manufacturers. The petitioner-Company operates under valid licenses and are with due compliance of GST and e-way Bill.

3. There had been hijacking of the Trucks on various dates and still now, they had not given either any CSR or registered the FIR for the on-line complaints.

4. Further, GPS tracking systems are located with precision location and despite detailed on-line and physical complaints, including submission of documentary evidence and GPS reports, the second respondent refused to act or register the FIR.

5. As the goods belong to a reputed cement manufacturing company, and delay in delivery may result in the petitioner being saddled with the compensation for delay, and the petitioner is forced to release the vehicle to the dictates of the second respondent and the hijackers.

Further, if the respondents are permitted to continue their in-action, the petitioner-Company will suffer grave and irreparable loss, both reputational and financial and hence, the petitioner-Company prays for a direction to the second respondent to register the FIR on the basis of the petitioner's complaint dated 18.07.2025.

7. Heard both sides and perused the materials available on record.

8. This Court is of the view that the petitioner-Company will have to work out their remedy in the manner known to law only before the competent Criminal Court. Hence, this Court is not inclined to entertain the present Writ Petition with the relief sought for by the petitioner, since there is a specific provision in the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023), for approaching the Magistrate for necessary relief.

9. Hence, this petition is dismissed, with liberty to the petitionerCompany to work out their remedy in the manner known to law before the 3 / 5

competent Criminal Court.
