C.M.P.No.4702 of 2023 in C.M.A.SR.No.79625 of 2022 N.MALA,J., This Civil Miscellaneous Petition has been filed to condone the delay of 85 days in filing the above Civil Miscellaneous Appeal.

2. The learned counsel for the petitioner prays to dispense with the notice to the 1st respondent as he remained ex-parte in the Court below and he has made an endorsement to that effect.

3. In view of the above submission, notice to the 1st respondent is dispensed with.

4. Though notice was served on the 2nd respondent and his name appears in the list, none appears for the 2nd respondent before this Court.

5. Mr.Michael Visuvasam, learned counsel takes notice for the 3rd respondent.

6. I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons stated therein. Therefore, the delay of 85 days is condoned.
