Certificate to the petitioner to enable him to participate in the works issued vide Tender Notice Number S.W.D.C No.B1/1645/2025 dated 10.07.2025 and in the alternate to direct the respondent to accept the tender documents to be uploaded by the petitioner without insisting the production of Site Visit Certificate for the above said work.

ORDER
The above writ petition is filed for a Writ of Mandamus, directing the respondents to issue the Site Visit Certificate to the petitioner to enable him to participate in the works issued vide Tender Notice Number S.W.D.C No.B1/1645/2025 dated 10.07.2025, and in the alternative, to direct the respondents to accept the tender documents to be uploaded by the petitioner, without insisting production of Site Visit Certificate for the aforesaid work.
2. Petitioner is a Class I contractor and carrying out works in various departments of the Government for the past 16 years. The respondent invited application from the eligible contractors for the tender process to be held on 28.07.2025, vide Tender Notice Number S.W.D.C.No.B1/1645/2025, dated 2 / 6
10.07.2025. The petitioner decided to participate in the works notified in the tender notification, and so he approached the respondent and requested for Site Visit Certificate, which was one of the conditions to participate in the tender process. As the respondent did not issue the Site Visit Certificate, the petitioner sent a representation through mail on 10.07.2025, and a further representation to the 1st respondent on 11.07.2025, for issuance of the Site Visit Certificate. Since the aforesaid certificate was not issued, the petitioner filed the above writ petition for the aforesaid relief.
3. Heard both the learned counsels and perused the materials placed on record. With the consent of both the learned counsels, the main writ petition is disposed of at the admission stage itself
4. At the time of admission, the learned Standing Counsel for the respondents submitted that the tender process is to be held on 28.07.2025, and that the respondents will issue Site Visit Certificate to the petitioner by 11.00 a.m on 25.07.2025.

5. Recording the statement of the learned Standing Counsel for the respondents, the writ petition is disposed of. It is clarified that the respondents need not wait for the web copy of this order and may commence the process forthwith. However, there shall be no order as to costs.
