ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 03.11.2021 for the offences under Sections 147, 341, 364, 302, 201, 120B of IPC, in Crime No.1189 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the deceased had married the daughter of the petitioner without the knowledge of their parents. Thereafter, the deceased was found missing from 27.10.2021. Hence, the case was initially registered for "Man Missing". Later during investigation it was found that the relationship between the daughter of the petitioner and the deceased is a brother and sister relationship. Hence, it was opposed by both the families. However the deceased refused their listen to their advice. Hence, on the instigation of the petitioner, the other accused murdered the deceased and thrown the body into a Brick Kiln Chamber. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and she has been falsely implicated in this case based on the confession of A1. He would further submit that the petitioner has been suffering incarceration for 40 days from 03.11.2021. Hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner is arrayed as A5 and she is the mother of deceased's wife and on the instruction of the petitioner, the other accused has committed the murder of the deceased and that the investigation has not been completed.

5. It is seen that the deceased who was called for a compromise meeting has been murdered and a gang of persons are involved in this case and that the investigation has not been completed. On seeing the grave nature of the offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
