O R D E R

This petition has been filed for a direction to the court below to complete the proceedings in C.C.No.177 of 2015 within the time frame fixed by this court.

2.The learned Additional Public Prosecutor on instructions submitted that the investigation was conducted on a case and counter and final report was filed in the both cases. C.C.No.177 of 2015 is pending before the learned Judicial Magistrate-III, Erode and C.C.No.39 of 2015 is pending before the learned Judicial Magistrate-II, Erode. It was brought to the notice of this Court that the trial has not commenced in both the cases. 3.In the light of the above submission, the case in C.C.No.39 of 2015 pending on the file of the learned Judicial Magistrate-II, Erode is withdrawn and is transferred to the file of the learned Judicial Magistrate-III, Erode to be tried along with CC.No.177 of 2015 in line with the judgment of the Apex Court in Nathi Lal and others vs. State of Uttarpradesh and another 2/4

reported in 1990 (Supp) SCC 145. The Trial Court shall complete the proceedings, within a period of six months from the date of receipt of copy of this order.
