O R D E R

When the matter is taken up for hearing on 20.02.2024, there was no representation on behalf of the petitioner. In order to give an opportunity, the matter was adjourned today i.e., 05.03.2024. Even today, there is no representation for the petitioner. Hence the following order is passed by perusing the affidavit and typed set papers.

2. The petitioner herein filed a Writ Petition before this Court on 27.10.2015 challenging the order passed by the respondent Corporation for taking possession under Section 29 of State Financial Corporation Act.

3. When the Writ petition came up for hearing, this Court passed the following order:

"4. Considering the submission made by the counsel appearing for the petitioner and the respondent, petitioner is directed to submit his fresh proposal for One Time Settlement (OTS), within a period of two weeks from the date of receipt of copy of this order.

5. The respondent Corporation is directed to consider the One Time Settlement (OTS) offer made by the petitioner within a period of 6 weeks 2/4

thereafter".

4. It is seen from the affidavit of the petitioner that a fresh proposal for One Time Settlement (OTS) was submitted by the petitioner offering to pay a sum of Rs.30 lakhs by a letter dated 30.12.2022. The respondent Corporation vide its reply letters dated 03.02.2023 and 17.02.2023 had given a direction to pay principal amount outstanding plus 25% of the total interest accrued as on 31.03.2022. The said averment by the petitioner would suggest that a fresh proposal of the petitioner for One Time Settlement was considered by the respondent Corporation and order has been passed. In such circumstances, directions issued in the Writ petition was duly complied with and there is no act of contempt on the part of the respondent.
