ORDER

The petitioner has come forward with this petition seeking a direction to the respondent to register the complaint dated 12.02.2016 and to take suitable action known to law against the accused person.

2.The learned counsel for the petitioner submitted that the petitioner filed O.S.No.1109 of 1997 for injunction against the counter petitioner. The suit was dismissed against which she preferred an appeal in A.S.No.69 of 2010 and it was allowed against which the counter petitioner filed second appeal in S.A.No.7 of 2014 and it was dismissed. So, injunction has been granted in favour of this petitioner and when they were cleaning the property, the counter petitioner attempted to interfere and made criminal intimidation. Hence, the petitioner lodged a complaint on 12.02.2016. But, the respondent has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief.

3.At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that on receipt of the complaint, enquiry was conducted and since the petitioner herself stated that she would work out the remedy before the Court, it was closed and hence, prayed for the dismissal of the petition.

4.Considering the rival submissions made on both sides and on a perusal of the file produced by the learned Additional Public Prosecutor, it is known that enquiry has been conducted and counter petitioner one Raghupathi was called and he was also enquired and on that basis only, it was closed. Hence, recording the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of.
