O R D E R
The petitioner has come forward with this petition seeking a direction to the respondents to register the case on the basis of the complaint given by the petitioner dated 05.02.2011. 2.Learned counsel for the petitioner submits that one Jayaseelan contacted the petitioner saying that he has influence in the Education Department and that he received a sum of Rs.3,50,000/- from him by promising to get the Government job for petitioner's wife. He further submits that the said Jayaseelan neither repaid the amount nor arranged job for petitioner's wife. So the petitioner approached the said Jayaseelan and demanded the amount. But he threatened him. https://hcservices.ecourts.gov.in/hcservices/
Therefore, the petitioner has lodged a complaint before the respondents. But the respondents without conducting enquiry, closed the complaint on 12.03.2012 itself. Hence, the petitioner has come forward with this petition for the above stated relief. 3.Learned Additional Public Prosecutor submits that after conducting enquiry, the petitioner's complaint was closed as early as on 12.03.2012 and no complaint given by the petitioner has been pending before the respondents. Hence, he prays for dismissal.
4.Heard both sides.
5.A perusal of the typed set of papers reveals that the petitioner has given a complaint dated 19.05.2010 before the Honourable Chief Minister and Governor and he has also given another complaint dated 05.02.2011 before the Education Minister. On that basis, enquiry has been conducted and the complaints have been closed on 12.03.2012 itself. Under such circumstances, I am of the view that the petition filed by the petitioner in the year 2016 amounts to abuse of process of Court. Therefore, the Criminal Original Petition stands dismissed.
