Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the 3rd and 4th respondents to consider the petitioner's application dated 04.06.2016 for patta name transfer and sub-division in accordance with law within the time stipulated.

ORDER

Heard the learned counsel for the petitioner and Mr.O.S.Maheswaran, learned Government Advocate who accepts notice on behalf of the respondents and with the consent on either side, the writ petition is taken up for final disposal. The petitioner would state that he had inherited the property/land by way of Gift Deed from his father bearing Document No.1598/2006 dated 24.05.2006 and he is in absolute possession and enjoyment of the said land doing cultivation. It is his further case that at the time of registration, the petitioner had paid requisite fees for sub-division and for name transfer in the patta. On 04.06.2016, the petitioner has applied for name transfer before the 4th respondent along with necessary documents and fees. Till date, no response is forthcoming from the 4th respondent. The petitioner placed reliance on G.O. {Ms} No.

210 dated 08.07.2011 passed by the Revenue [S.S.[1]] Department and People's Charter, wherein, the Revenue Tahsildar concerned has to effect name transfer and sub-division within a period of thirty days from the date of receipt of the application. But, till date, the petitioner has not been favoured with any kind of response.

Hence, he has come forward to file the present writ petition. Taking into consideration the limited scope of prayer sought for by the petitioner, this Court, in view of the above facts and circumstances and without going into the merits of the claim projected by the petitioner either in this writ petition or in the representation dated 04.06.2016, directs the respondents 3 and 4 to consider and dispose of the petitioner's representation dated 04.06.2016 on merits and in accordance with law and pass orders as expeditiously as possible and communicate the decision taken, to the petitioner. The writ petition is disposed of with the above direction. No costs.
