No. SE/GCC/CBE/DB/D3/F.K2.Agt.No.78/2k-01/D.41/01 dated 17.04.2001 and Lr.No.SE/GCC/CBE/DB/D3/F.K2.Agt.No.2294/ D.42/2001 dated 17.04.2001 and the consequential proceedings passed by the second respondent in Lr.No.ACE/MTR/AEE/Civil/ D.Man/F.Specn.C.29/03-04/D.457/2004, dated 22.07.2004 quash the same and direct the second respondent to issue work orders to the petitioner in respect of Tender for construction of Cement Shed at PSP yard, Nehru Nagar, Mettur Dam dated 21.01.2004. The learned counsel appearing for the petitioner submits that the relief sought for in this writ petition has become infructuous and hence the writ petition may be dismissed as infructuous. He has also made an endorsement to that effect in the petition.
