This civil miscellaneous petition is filed seeking to condone the delay of 70 days in filing the above appeal.

2. Heard the learned counsel for the petitioner/appellant.

3. Notice to the respondents 2 and 3 were already dispensed with. Though paper publication has been effected on behalf of the 1st respondent and proof of paper publication has been filed, however, and he has not entered appearance either in person or through counsel.

4. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.

5. Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order and list the same for admission.
