ORDER
The petition has been filed to withdraw H.M.O.P. No.72 of 2023 pending on the file of Subordinate Court, Mettur and transfer the same to the file of the Family Court, Salem.
2. Heard Mr. K. Selvaraj, learned counsel appearing for the 1/3
petitioner.
3. This proceeding is at the instance of the wife seeking transfer from Sub Court at Mettur to the Family Court at Salem. The H.M.O.P. No.72 of 2023 has been filed by the husband seeking divorce. The wife is the resident of Salem. The distance between Salem and Mettur is not incredibly long for the Court to consider the inconvenience of the wife. Apart from that, in case the proceedings are pending before the Family Court, for each and every hearing, both the parties would have to appear before the Court personally. If the matter is pending before the Sub Court, there is no necessity for the wife to appear for every hearing and she can be represented through her counsel.
4. Considering the facts and circumstances, I am not inclined to allow the petition and accordingly, the transfer Civil Miscellaneous petition is dismissed. No costs. The connected miscellaneous petition is closed.
