ORDER
This writ petition has been filed to forbear the respondents, their subordinates from preventing the petitioner from drawing the water from the Rock Pit (Paarai Kuzhi) situated in his lands in S.F. Nos. 129/3A , 3B at Sukkampalayam Village, Palladam Taluk, Tiruppur District and transporting and supplying the same.
2. It is stated that the petitioner is the owner of the lands measuring 62 cents 160 square feet in S.R. Nos.129/3A, 3B & 3C situated at Sukkampalayam Village, Palladam Taluk, Tiruppur District and registered on the file of SRO, Palladam vide Sale Deed dated 12.11.2010 in Doc. No.16252 of 2010. In the midst of the petitioner's lands, there was a Rock Pit (Paarai Kuzhi) and in which rain water got stagnated and out of which bad odour emanated. In such circumstances, the petitioner has submitted various representations and the 2/5
latest being sent to the 1 st respondent on 04.05.2023 with regard to drawing, transportation and supply of the said water to nurseries. It is the grievance of the petitioner that the respondents are preventing him from doing such activity. Hence, left with no other remedy, he approached this Court with the aforesaid prayer.
3. Learned counsel for the petitioner submitted that the petitioner is not drawing water from beneath the surface and supplying it and it is only a stagnated rain water. Hence, this Court may issue appropriate directions to the respondents from restraining the petitioner to remove the said water.
4. Learned Government Advocate appearing for the respondents has stated no objection for issuance of such a direction.

Considering the limited request sought for by the petitioner, this Court directs the petitioner to submit a copy of the earlier representation dated 04.05.2023 to the 1 st respondent, along with this order copy, within a period of four weeks from the date of receipt of a copy of this order. On such submission, 3/5
the 1 st respondent shall survey the said land and pass orders on the petitioner's representation, in accordance with law, within a period of four weeks thereafter.
