ORDER

Though the petitioner has filed the present petition for transfer of the case from the third respondent to some other investigating agency, it is seen from the records that the accident had taken place on 10.05.2024 and the learned counsel for the petitioner submitted that within a short distance, there was a Toll-gate and even though the respondents have not taken effective steps to find out the real person who had committed the offence, he seeks time for verification. Since the accident had taken place and the complaint was also made on the same day, the Station House Officer is not interested to conduct the investigation properly and therefore, this Court is not satisfied with the action so far taken by the third respondent-investigating officer.

Therefore, the second respondent is directed to withdraw the case from the file of the third respondent and hand over it to some other investigating officer to conduct the investigation. Accordingly, the second respondent is directed to take action against the third respondent also and initiate departmental enquiry and file a report. With these observations, the Criminal Original Petition is disposed of. 06.11.
