Crl.O.P.No.5992 of 2016 K.KALYANASUNDARAM.J., The petitioner, who is arrayed as A7, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 395 of IPC in Crime No.491 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that 26.02.2015 at 07.30 a.m., the accused along with others have trespassed into the house of the defacto complainant and committed robbery by tying hands of the defacto complainant and his mother. 3.The learned counsel appearing for the petitioner would submit that the petitioner/A7 is an innocent person and he has been falsely implicated in this case. Further, it is submitted that the main accused/A1 and A2 were already released on bail by the Sessions Court on 06.02.2016 in Crl.M.P.No.282 of 2016. 4.

The learned Government Advocate (Crl.Side) would submit that totally there were 11 accused involved in this case. All the accused have trespassed into the house of the defacto complainant and taken away 10 sovereigns of gold and a cash of Rs.25,000/-. Further, it is submitted that the investigation is pending in this case. 5.Considering the nature of the allegation and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
