This petition has been filed seeking a direction to transfer the investigation and also to file a fresh charge sheet in C.C.No.1501 of 2014 on the file of the learned Chief Metropolitan Magistrate, Allikulam, Egmore, Chennai.
2. It is seen that the respondent police has completed the investigation in Crime No.767 of 2012 and filed a final report. The final report has been taken cognizance in C.C.No.1501 of 2014 on the file of the learned Chief Metropolitan Magistrate, Allikulam, Egmore, Chennai and the same is pending for trial. At this stage, the transfer of investigation does not arise since no investigation is pending on the file of the respondent police. However, the https://hcservices.ecourts.gov.in/hcservices/
petitioner can very well approach the trial Court by invoking Sections 216 and 319 of Criminal Procedure Code, during the trial.
3.With the above direction, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
