These petitions have been filed seeking condonation of delay of 396 days in filing the petitions to set aside the abatement caused due to the death of the third respondent L.Arumugam, to set aside the abatement and to bring on record respondents 3, 4 and 5/proposed parties as the legal representatives of the deceased third respondent. Despite service, none appears for the proposed parties either in person or through counsel duly instructed.
2. Accepting the reasons assigned in the affidavits filed in support of these petitions, all the petitions are ordered. The delay of 396 days is condoned, the abatement caused by the death of the third respondent is set aside and the respondents 3, 4 and 5/proposed parties are brought on record as the legal representatives of the deceased third respondent and ranked them as respondents 5, 6 and 7 in the Appeal.
