Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records connected with the Ref.No.8325/2023/B1 dated 30.09.2023 passed by the respondent herein and quash the same and consequently direct the respondent to reinstate the petitioner into service in the light of the Government Letter No.13519/N/2015-1 dated 23.07.2015 and Government Order in G.O.Ms.No.81 Human Resources Management (N) Department dated 04.08.2022.

This writ petition has been filed challenging the impugned proceedings of the respondent dated 30.09.2023 wherein the petitioner has been placed under suspension.

2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondent. 3.The case of the petitioner is that he was working as Village Administrative Officer. Through proceedings dated 30.09.2023, the respondent placed the petitioner under suspension based on a criminal case registered in Crime No.8 of 2023, in which the petitioner has been arrayed as an accused. The said order has been put to challenge in the present writ petition.

4.In the considered view of this Court, there is no need for this Court to interfere with the order of suspension passed on 30.09.2023 at this length of time. However, it is seen from the records that the petitioner has already submitted a representation dated 22.04.2024 requesting the respondent to revoke the order of suspension and to 2/4

reinstate the petitioner. The same is pending consideration before the respondent. Therefore, it will be suffice if a direction is given to the respondent to deal with the representation made by the petitioner on 22.04.2024 within a time frame fixed by this Court. 5.In the light of the above discussion, there shall be a direction to the respondent to deal with the representation made by the petitioner on 22.04.2024 on its own merits and in accordance with law and pass orders within a period of six (6) weeks from the date of receipt of a copy of this order.

6.In the result, his Writ Petition is disposed of with the above directions. Consequently, the connected Miscellaneous Petition is closed. No costs.
