ORDER

This petition has been filed to direct the second Respondent police to register the case on the complaint given by the petitioner dated 02.11.2015 and consequently to take action as per law against the accused.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. On reading of the complaint dated 02.11.2015, it appears that, this petitioner has sold the vehicle for Rs.2,30,000/- to one Thangavel, who has failed to pay the amount agreed and hence the petitioner lodged a said complaint. Since, no action has been taken by the respondents against the said person, the petitioner has filed this petition.

4. The learned Additional Public Prosecutor submitted that during enquiry, it is found that the opposite party had paid a sum of Rs.90,000/- and had agreed to pay the balance.

5. Taking into consideration the nature of allegation and the fact that the incident has taken place in the year 2015, this is not a fit case for issuing a direction to the respondent police to register an F.I.R and conduct an enquiry expeditiously and proceed in accordance with law.

6. With the above directions, this Criminal Original Petition is closed, with liberty to the petitioner to workout his remedies in the manner known to law.
