ORDER
This writ petition has been filed Seeking a direction to the respondents 1 to 3 to conduct an enquiry on the basis of the petitioner's complaint dated 01.03.2025.
2. It is the grievance of the petitioner that her brother, Gunasekaran/6th respondent has sold the property including her share despite the pendency of the partition suit in O.S.No.216 of 2023 on the file of the Sub Court, Gingee for partition. Therefore, she sent a police complaint to the respondents 1 to 3, requesting them to take action against the Sub Registrar and others, viz., respondents 4 to 9 for registering the document. But, no action has been taken so far. Hence, the present petition has been filed.
3. Heard, the learned Government Advocate(crl.side) appearing for the respondents 1 to 3 and the learned Special Government Pleader appearing for the 4th respondent.
4. This Court is of the view that, at the outset, the very complaint for police investigation is misconceived. Since the partition suit is already pending, 3/6
if at all any transfer has taken place during the pendency of the suit, such transfer is always subject to the result of the suit. Hence, I do not find any no merit in this petition.
