Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for entire records connected with the proceedings of the 1st Respondent in Na.Ka.No.16538/2016/A7 dated 09.12.2016 and quash the same consequently directing the 1st Respondent to include the petitioner's name in the state vide seniority list of Executive Officer Grade II / Head Clerk / Assistant and pass any such further or other orders as this Honourable Court may deem fit to the facts and circumstances of the case. O R D E R

The Writ Petition has been filed, seeking to quash the proceedings of the 1st Respondent dated 09.12.2016 made in Na.Ka.No.16538/2016/A7, by which the petitioner's request for

inclusion of his name in the State Vide Seniority List has been rejected. The petitioner also sought a direction to the 1st Respondent to include his name in the State Vide Seniority List of Executive Officer Grade II / Head Clerk / Assistant.

2. When the matter is taken up for hearing, learned counsel for the petitioner has submitted that a proposal dated 22.12.2018 has already been sent to the Government in respect of his claim and the same is pending. Hence, it would be sufficient for the Petitioner, if a decision is taken on the said proceedings that has been forwarded by the 1st Respondent in Na.Ka.No.2161/2018/A2 dated 22.12.2018 to the Government, namely, Principal Secretary to Government, Municipal Administration and Water Supply Department, Chennai, for necessary orders.

3. Learned Special Government Pleader appearing for the Respondents, by producing a copy of the proceedings dated 22.12.2018, has stated that a suitable decision will be taken by the Government on the same at the earliest point of time and this Court may consider fixing a time limit for taking a decision.

4. Taking note of the submissions made on either side and also considering the fact that the proceedings dated 22.12.2018 are pending with the Government, this Court directs the concerned Authority, more particularly, the Principal Secretary to Government, Municipal Administration and Water Supply Department, Chennai to take a decision on the proposal dated 22.12.2018 within a period of three months from the date of receipt of a copy of this order. No costs.
