Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus to forbear the respondents from interfering with the day-to-day affairs of the petitioner's club or its members and right to avail the facilities for playing rummy, carom, chess, and other indoor games by not involving any element of gambling in its premises at Plot No.2A, RS.No.808, K.K.Nagar, Vaikkalmedu, Perundurai Road, Erode District. Heard the learned counsel for the petitioner and Mr.A.Kumar, learned Special Government Pleader who accepts notice on behalf of
the respondents.
B.RAJENDRAN, J., AP Since this Court has expressed its view that a writ petition filed by an Association, is not maintainable, the learned counsel for the petitioner sought permission of this Court to withdraw this writ petition with liberty to file a fresh writ petition by the individual/affected person. He has also made an endorsement in the writ petition to that effect.
In view of the submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn and the liberty sought for by the petitioner, is granted. No costs.
