ORDER

The petitioner has come forward with this petition under Section 482 of the Code of Criminal Procedure, seeking for a direction directing the respondent police to investigate the FIR No.73 of 2015, dated 04.06.2015 based upon the complaint given by the petitioner and to take appropriate action against the accused and to file a detailed report before this Court within a stipulated time.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.73 of 2015 on 04.06.2015 for the offences punishable under Sections 294(b), 427 and 506(ii) of IPC. However, the respondent police has not shown any interest https://hcservices.ecourts.gov.in/hcservices/

to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

4. Resisting the same, the learned Additional Public Prosecutor would submit that investigation is going on and hence, he prays for one month time to complete the investigation and file a final report.

5. Considering the submissions made on both sides and also considering the fact that on the basis of the complaint given by the petitioner, after due enquiry, the case in Crime No.73 of 2015 has been registered as early as on 04.06.2015 for the offences punishable under Sections 294(b), 427 and 506(ii) of IPC, the respondent police is directed to complete the investigation in FIR No.73 of 2015 and file a final report, within a period of one month from the date of receipt of copy of this order.

6. The Criminal Original Petition is disposed of with the above direction.
