Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd Respondent to issue a Legal Heir Certificate in favour of the Petitioner for her deceased husband named Mr.P.Gopal based on the application of the Petitioner dated 11.03.2022 and the representation of the petitioner dated 12.09.2022 within any reasonable time as this Honble Court.

The prayer sought for herein is for a Writ of Mandamus directing the 2nd Respondent to issue a Legal Heir Certificate in favour of the Petitioner for her deceased husband named Mr.P.Gopal based on the application of the Petitioner dated 11.03.2022 and the representation of the petitioner dated 12.09.2022 within any reasonable time as fixed by this Court.

2. The petitioner made an application on 12.09.2022 to the second respondent to issue legal heir certificate as the petitioner is the wife of the deceased P.Gopal. However, the said application submitted by the petitioner since has not been considered and no orders have been passed with regard to the request of the petitioner, the petitioner has moved the present writ petition.

3. Heard Mr.S.R.Karthikeyan, learned counsel for the petitioner and Mr.N.Naveen Kumar, learned Government Advocate appearing for the respondents.

Since the Government has issued Government Order in G.O.Ms.No.478, Revenue and Disaster Management Department dated 29.09.2022 under which certain mandatory guidelines have been issued as to how the application for getting legal heirship certificate has to be dealt with and the process as to how those applications are to be disposed of, this Court feels that, based on the said G.O., the petitioner shall file an on-line application to the second respondent within a period of two weeks from the date of receipt of a copy of this order and on making such an application through on-line mode, the same shall be considered and orders shall be passed by the second respondent within a period of four weeks thereafter, of course in consonance with G.O.Ms.No.478 dated 29.09.2022.
